The rules to follow with AI in this job

Always do this

  • Client confidentiality: no exhibit and no client name in a personal or free account. Work in the firm’s workspace, with no training on your content, or with a tool that runs on the computer.
  • Every citation gets checked at the source. A general-purpose assistant can make up a decision: open the ruling before you cite it in a filing.
  • AI prepares, you decide and you sign. Your liability is the same as if you had written everything yourself.
  • Tell the client and get their consent before recording a meeting or having it transcribed.

Never hand this to AI

  • Case strategy and the assessment of the chances of success.
  • Calculating a procedural deadline or a statute of limitations, without recounting it in the texts.
  • A client’s exhibits that name people, in a free consumer tool.
